Excavation Near Neighbouring Buildings
Section 6 of the Party Wall etc. Act 1996 can apply to extension, basement and structural foundations close to neighbouring buildings.
Within 3 metres
Notice may be needed when proposed excavation is within 3 metres and below the bottom of the neighbour’s foundations.
Within 6 metres
Deeper excavation may be caught by the 45-degree test extending from the neighbour’s foundations.
Information needed
Foundation depth, sections, distances and—where relevant—structural engineering details.
Why depth information matters
A plan showing distance alone is not enough. The statutory tests compare the proposed excavation with the position and depth of the neighbouring foundations. Trial holes or other reasonable investigation may sometimes be needed.

Is every excavation within 3 metres notifiable?
No. The proposed excavation must also be deeper than the bottom of the neighbour’s foundations.
